    I'm not saying that this is the right thing to do, but it looks like the real estate cartel is trying to protect it's own interests with this form - it's not one of the promulgated TREC forms. You might want to call an attorney. (I know it's a few years ago, but I didn't want anyone else reading this to miss this clause)

    Curious as to where you got the CAR Forms in the first place. (Ahhh you and I posted almost the same time) We pay quite dearly to have those forms for our use. Your link shows a severely outdated form. It's been revised 5 times since the 2002 revision you're working on. Is her gift designed to help you qualify for the loan?

    Well it still depends on whether or not the disclosure is an addenda to the contract or not. I know our Oregon contracts state that if it isn't in the purchase and sale agreement it isn't part of the sale. Our disclosure forms are part of our contracts and assigned as addenda, so out here it would probably count as part of the contract.

    This and keep in mind the Listing agreement is a Broker Internal Form that can be changed to meet the circumstance unlike the Texas TREC Contracts. Easy for an agent to pencil in several properties. Note the TX Contract is for a 1 to 4 Family Residential Properties. Those 4 sold together can be on one listing agreement and one contract.
